1. Membership Plans: Basic, Premium, Elite
This Tire Assist Club (“the Club”) is governed by the terms and conditions outlined below. By signing the Membership Contract, the Member agrees to adhere to these terms during the membership period.
2. Membership Plan Benefits:
2.1 Service Area:
The Club provides coverage within specified radius for each plan:
- Basic: 30-mile radius
- Premium: 40-mile radius
- Elite: 60-mile radius
2.2 Service Calls:
The number of service calls varies by plan:
- Basic: Up to four service calls per year
- Premium: Up to five service calls per year
- Elite: Up to six service calls per year
2.3 Service Hours:
Members services are available every day from 6 AM to 9 PM.
2.4 Guaranteed Response Time:
Members can expect a response time of 45 to 90 minutes for on-site assistance. Note that weather conditions or any other inclement outside of our control might affect response times.
2.5 Service Inclusions:
The membership covers essential services as outlined in the Membership Contract.
3. Service Call Clarification:
3.1 Inclusions Calculation:
For service calls with 1-2 tire-related services, it will be recorded as 1 service call. For 3-4 services requested in one call-out, it will count as 2 service calls.
4. Plan Exclusions:
4.1 Scope:
The Club does not cover certain issues such as sidewall damage, rim damage, stripped, specialty, or locking lug nuts, towing, wheel installation, tires installation, oversized tires (24 or 26-inch), RVs, and commercial vehicles.
5. Additional Information:
5.1 Technician Wait Time:
Technicians can wait for a maximum of 15 minutes at the location. Members are required to grant timely access to the technician to reach the vehicle.
6. Tire Warranty and Service Clarification:
6.1 Membership Plan Distinction:
The Club membership plan is distinct from any type of tire warranty.
6.2 Tire Balancing:
Tires installed by the mobile service must be brought to the service shop for proper tire balance, a complementary service.
6.3 Optional Road Hazard Tire Warranty:
After tire balance, the customer has the option to purchase a Road Hazard tire warranty at an extra cost.
7. Pricing Details:
7.1 Monthly Fee:
Members agree to pay a monthly fee as per their selected plan and outlined in their contract.
7.2 Price Changes:
Prices for membership plans and services are subject to change. Members will be promptly notified of any adjustments.
8. Recurring Payments and Credit Card Authorization:
8.1 Recurring Payments:
Members agree to automatic recurring payments for the membership fee. The original credit card used for the first payment will be charged monthly.
8.2 Credit Card Authorization:
Members authorize ACE Mobile Tire Service to charge the monthly membership fee to the credit card provided at the time of purchase.
8.3 Card Update:
Members may call to update their credit card information at any time.
9. Membership Duration:
9.1 Start Date:
The Club membership starts on the date this contract is signed and will be billed monthly until canceled or until monthly payments default. Ace Mobile Tire Service reserves the right to reject or cancel an individual’s membership at any time, based on our discretion.
9.2 Usage within 48 Hours:
If a member utilizes benefits within the initial 48 hours, they are responsible for a minimum of 50% of the retail price for services rendered.
9.3 Cancellation:
Cancellations are free after the first six months. Before six months, a $50 cancellation fee applies. If canceled within the initial three months with benefits utilized, the member will be responsible for payment of the full retail price of the services.
10. Transferability:
This membership is for the original purchaser and immediate family members driving the covered vehicle. It is not transferable. Only the covered vehicle will be serviced.
11. Liability Waiver and Indemnification:
11.1 Member Responsibility:
The Member acknowledges that the services provided by ACE Mobile Tire Service are based on the information provided by the Member and are contingent on the accuracy of this information.
11.2 Assumption of Risk:
The Member understands and accepts the inherent risks associated with roadside assistance and tire-related services, including but not limited to the potential for accidents due to faulty tires, injuries, or damage to the vehicle, etc.
11.3 Liability Waiver:
The Member agrees to waive any claims against ACE Mobile Tire Service, its employees, agents, and affiliates, arising from or related to the services provided under this contract, except for claims arising from willful misconduct.
11.4 Indemnification:
The Member agrees to indemnify and hold ACE Mobile Tire Service harmless from any third-party claims, damages, losses, liabilities, costs, and expenses (including reasonable attorney’s fees) arising from the Member’s use of the services or any breach of the terms of this contract.
11.5 No Legal Action:
The Member agrees not to initiate legal action against ACE Mobile Tire Service for any reason, except for claims arising from willful misconduct.
12. Agreement:
The Member acknowledges and agrees to all the terms and conditions outlined in the Membership Contract.
